Rights and duties of the Appellate Council operating under the ASA

 

The Appeals Council has the following rights within its duties:

  • To send requests to appraisers performing legal and physical activities in connection with appeals received from people who use appraiser services to the Appeals Council, to receive the necessary documents and information from them;
  • To invite the persons who have filed a complaint and the officials of the relevant appraisal company to the meetings of the Appeals Council, conduct an investigation with their participation, and receive explanations from them;
  • To issue written instructions to the managers of the relevant valuation companies regarding the elimination of defects and violations discovered during the examination of the appeals submitted to the Appeals Council;
  • In the course of examining appeals submitted to the Appeals Council, in case the appraiser commits gross errors in the performance of his service activities, as well as cases of violations of the requirements of laws and standards, to raise the issue before the ASA Board of Directors in order to hold those companies or individuals accountable;
  • To make suggestions for increasing the efficiency of the Appeals Council's activity;
  • Conducting analyzes and generalizations in the process of the Appeals Council's activity, making suggestions regarding the elimination of contradictions discovered during the examination of appeals;
  • To monitor and control the implementation of the decisions of the Appeals Council, as well as to take measures to eliminate deficiencies.

The duties of the Appeals Council are as follows:

  • To conduct a comprehensive, complete and objective investigation of appeals received by the Appeals Council and make a decision based on the outcome of the case accordingly;
  • To conduct a comprehensive, complete and objective investigation of the complaints received by the Appeals Council and give a reasoned opinion on the outcome of the case;
  • To control the implementation of the decisions made by the Appeals Council;

To keep records of appeals considered in the Appeals Council, to analyze them.
